REGULATIONS OF THE ONLINE STORE "SZALUJ.PL"
1. GENERAL PROVISIONS
- These regulations (hereinafter referred to as the Regulations) define the rules for concluding and performing sales agreements in the online store “szaluj.pl” (hereinafter referred to as the Store) run by BAUKRANE Spółka z ograniczoną odpowiedzialnością with its registered office at ul. Jana Keplera 36, 80-299 Gdańsk, entered into the register of entrepreneurs of the National Court Register by the District Court of Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register, KRS: 0000940665 NIP: 584-26-59-127 REGON: 220662972 (hereinafter referred to as the Seller).
- The Store can be used via the website szalauj.pl (hereinafter referred to as the Website).
- The Regulations constitute an integral part of the sales contract concluded with the Buyer.
- The conclusion of a sales contract via the Store requires prior acceptance of the Regulations.
- The information contained on the Website does not constitute an offer within the meaning of the Civil Code but is an invitation for the buyer to submit a purchase offer (hereinafter referred to as the Order).
- A sales agreement via the Store may only be concluded by adult natural persons who are consumers, as well as adult natural persons conducting business activities who perform a legal act directly related to their business or professional activity, legal persons and organizational units without legal personality to which the law grants legal capacity, whereby persons acting on behalf of and for the benefit of legal persons and organizational units without legal personality are deemed to be entities duly authorized to act on behalf of the above entities.
- The Seller reserves that used goods may have natural traces of use.
2. REGISTRATION
- The order can be placed by both a registered buyer and an unregistered buyer in the Store. In the case of placing an order by an unregistered buyer in the Store, it is necessary to provide the information referred to in §2 section 3.
- Registration in the Store is voluntary and free of charge.
- Name and surname or company,
- Residential address or registered office address, and in the case of natural persons conducting business activity, the address of the principal place of business activity;
- Correspondence address, if different from the one indicated in the sub-item above;
- Tax Identification Number in the case of entrepreneurs;
- Email address.
- In order to register an account, it is required to provide data marked as mandatory in the registration form. Providing data marked as optional is voluntary and is not a condition for registration.
- After completing and sending the registration form, the buyer will receive a registration confirmation to the email address provided by him/her along with a temporary access password, which can then be changed by the buyer.
- In order to activate the account, it is necessary to confirm the registration in accordance with the information provided in the email referred to in §2 section 4.
3. ORDERS
- Orders in the Store are placed via the order form available on the Website (hereinafter referred to as the Form), in which the purchased goods, their quantity, preferred form of payment and the method and place of delivery of the goods should be indicated.
- In order to place an Order and its further execution, a Buyer who is not registered in the Store is obliged to provide the following data in the Form, in addition to the data indicated in paragraph 1:
- The Seller confirms acceptance of the Order by email.
- The moment of confirmation of acceptance of the Order by the Seller constitutes the moment of conclusion of the sales contract.
- A consumer and a natural person concluding a contract directly related to their business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed by them, made available under the provisions on the Central Register and Information on Business Activity (hereinafter referred to as the Entrepreneur with consumer rights), who have concluded a distance contract or a contract outside the business premises, have the right to withdraw from it without giving a reason within 14 days from the day on which the consumer came into possession of the goods or on which a third party other than the carrier and indicated by the consumer came into possession of the goods.
- A consumer is a natural person who enters into a legal transaction with an entrepreneur that is not directly related to their business or professional activity. Whenever these regulations mention a consumer, this should also be understood as an Entrepreneur with consumer rights.
- The right to withdraw from a contract concluded outside the business premises or at a distance does not apply to entities indicated in point 5 in relation to contracts:
– where the subject of the provision is a non-prefabricated product, manufactured according to the consumer’s specifications or intended to meet his individual needs;
– where the subject of the provision are goods which after delivery, due to their nature, are inseparably connected with other goods.
- To exercise the right of withdrawal, you must inform the Seller of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or e-mail).
- The consumer may use the model withdrawal form attached to these regulations, but this is not obligatory.
- In order to meet the deadline for withdrawal from the contract, it is sufficient to send information regarding the consumer's exercise of the right to withdraw from the contract before the deadline for withdrawal expires.
- In accordance with applicable legal provisions (Article 106b, section 5 of the VAT Act (Journal of Laws of 2019, item 1520), which entered into force on January 1, 2020, we cannot issue an invoice to a company for a document that does not include the Tax Identification Number.
4. PAYMENTS
- The Buyer may choose one of the payment methods indicated by the Seller in the Form, i.e.
- payment by bank transfer (after receiving the pro-forma invoice),
- payment in cash on delivery (option available for payments up to PLN 15,000 gross),
- by card or fast online transfer via the Autopay system.

- Available payment methods (payment cards):
- The order fulfillment time is counted from the date of payment being credited to the Seller's account.
- In the event of the need to return funds for a transaction made by a customer with a payment card, the seller will make a refund to the bank account assigned to the Ordering Party's payment card.
- The condition for the Seller to ship the goods is the full payment of the price for the goods together with the shipping costs.
- If payment is not credited to the Seller's account within 3 days from placing the order, the Seller reserves the right to withdraw from the sales contract.
- The buyer is obliged to cover the costs of delivery of the goods, except for situations where the parties make different arrangements as a result of individual agreements.
- Prices given in the Store are net prices and do not include shipping costs. VAT will be added to the prices given on the invoice at the rate applicable on the day the invoice is issued.
- The shipping costs for the goods are presented before in the order summary on the Website.
- After the payment has been recorded and the goods have been shipped, the Seller informs the buyer by email.
- The Seller sends the VAT invoice including the price of the goods and shipping costs to the Buyer by email or by post to the Buyer's address.
5. DELIVERY
- Goods ordered by the Buyer are delivered in one of the following ways:
- by courier or freight forwarding,
- by personal collection from the Seller's warehouses (after prior arrangement of the date with the Seller, but no later than 7 days from the date of placing the Order),
- The Seller is obligated to ship the goods within 7 days from the date of receipt of payment.
- In the event of unavailability of all or part of the goods, the Seller shall immediately inform the buyer of this fact, indicating at the same time the status of the order and the expected time of its completion. In such a situation, the buyer has the possibility to choose one of the following methods of order completion:
- partial execution of the order by the Seller,
- full execution of the order by the Seller with an extended, individually determined waiting time for the goods,
- cancellation of the Order in its entirety.
- The person personally collecting the goods on behalf of the buyer should present an identity document with a photograph and provide written authorization to collect the goods signed by the buyer, and in the case where the buyer is a legal person or an organizational unit without legal personality, signed by persons authorized to represent it, together with an extract from the National Court Register. The seller reserves the right to refuse to release the goods in the event of failure to fulfill the obligation indicated in the first sentence.
- The Seller reserves the right to withdraw from the sales contract in the situation referred to in §5 section 1 letter b, if the Buyer fails to collect the goods within the agreed time.
- At the buyer's request, the seller provides the consignment numbers for the goods ordered by the buyer.
6. WARRANTY FOR DEFECTS AND COMPLAINTS
The seller reserves that he is not liable to the buyer who is an entrepreneur under the warranty for physical defects of the sold item. This exclusion does not affect the buyer's rights under the manufacturer's warranty, if such has been granted.
The seller is responsible for the conformity of the goods with the contract.

§7 - RETURNS
- The Seller does not accept returns of goods purchased by entrepreneurs, with the exception of entrepreneurs with consumer rights who have withdrawn from the contract within the deadline.
- In the event of withdrawal from the contract, the consumer is obliged to return the goods to the Seller or hand them over to a person authorized by the Seller to collect them immediately, but no later than 14 days from the date on which he withdrew from the contract.
- The consumer bears only the direct costs of returning the goods. If the consumer has chosen a method of delivery of the goods other than the cheapest standard method of delivery offered by the Seller, the Seller is not obliged to reimburse the consumer for the additional costs incurred by him.
- The consumer is liable for any reduction in the value of the goods resulting from using them in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.
- The Seller shall immediately, no later than within 14 days from the date of receipt of the consumer's declaration of withdrawal from the contract, return to the consumer all payments made by him, including the costs of delivering the goods.
- The seller refunds the payment using the same method of payment that the consumer used, unless the consumer has expressly agreed to another method of refund that does not involve any costs for him.
- If the Seller has not offered to collect the goods from the consumer himself, he may withhold the reimbursement of payments received from the consumer until he receives the goods back or until the consumer provides proof of sending them back, depending on which event occurs first.
8. PERSONAL DATA PROTECTION
- A Buyer who is a natural person conducting business activity, when registering in the Store, and a Buyer who is not registered in the Store when placing an Order, provide only public data and information made available by the Central Register and Information on Business Activity.
- The controller of personal data is: BAUKRANE Sp. z o. o. with its registered office at Jana Keplera 36 in Gdańsk 80-299.
- We process personal data provided to us by Customers in a manner consistent with the scope of the consent granted by Customers and the requirements of the law, in particular in accordance with the Act of 25 May 2018 on the protection of personal data. We store Customers' personal data on servers ensuring their full security. Only authorized employees of the Store have access to the database.
- Every Client who has provided us with their personal data has full access to their data for the purpose of verification, modification or requesting deletion. The Store does not sell or lend the collected personal data of Clients to third parties, unless it is done with the express consent or at the request of the Client or at the request of the authorized state authorities under the law in connection with ongoing proceedings.
- The store transfers its customers’ data only to the extent necessary to complete the order, only and exclusively to business entities that mediate in the transaction, e.g. a courier company to deliver the order.
9. FINAL PROVISIONS
- In matters not regulated by the Regulations, the provisions of the Civil Code shall apply.
- It is prohibited to use any materials published on the Website (in particular photos and descriptions of goods) without the consent of the Seller expressed in writing under penalty of nullity.
- Any disputes arising from the non-performance or improper performance of the sales agreement will be submitted to the resolution of a common court having jurisdiction over the Seller's registered office.
- The Seller reserves the right to change the provisions of the regulations, and the regulations in force at the time of conclusion of the contract shall apply to sales contracts concluded before the date of entry into force of the changes.
- The Seller will post information about any changes to the regulations on the Website in the "News" tab.
The regulations enter into force on the date of publication: 20.12.2021
§2 - REGISTRATION
- The order can be placed by both a registered buyer and an unregistered buyer in the Store. In the case of placing an order by an unregistered buyer in the Store, it is necessary to provide the information referred to in §2 section 3.

§3 - ORDERS
- Orders in the Store are placed via the order form available on the Website (hereinafter referred to as the Form), in which the purchased goods, their quantity, preferred form of payment and the method and place of delivery of the goods should be indicated.
- In order to place an Order and its further execution, a Buyer who is not registered in the Store is obliged to provide the following data in the Form, in addition to the data indicated in paragraph 1:
- Business,
- Address of the registered office and, in the case of natural persons conducting business activity, the address of the principal place of business activity;
- Correspondence address, if different from the one indicated in the sub-item above;
- Tax Identification Number;
- Email address.
- The Seller confirms acceptance of the Order by email.
- The moment of confirmation of acceptance of the Order by the Seller constitutes the moment of conclusion of the sales contract.
- A consumer who has concluded a distance contract or an off-premises contract has the right to withdraw from it without giving any reason within 14 days.
- In accordance with applicable legal provisions (Article 106b, section 5 of the VAT Act (Journal of Laws of 2019, item 1520), which entered into force on January 1, 2020, we cannot issue an invoice to a company for a document that does not include the Tax Identification Number.
§4 - PAYMENTS

- When paying by card, the order processing time must be indicated from the moment of obtaining positive authorization.
- In the event of the need to return funds for a transaction made by a customer with a payment card, the seller will make a refund to the bank account assigned to the Ordering Party's payment card.
- The condition for the Seller to ship the goods is the full payment of the price for the goods together with the shipping costs.
- If payment is not credited to the Seller's account within 3 days from placing the order, the Seller reserves the right to withdraw from the sales contract.
- The buyer is obliged to cover the costs of delivery of the goods, except for situations where the parties make different arrangements as a result of individual agreements.
- Prices given in the Store are net prices and do not include shipping costs. VAT will be added to the prices given on the invoice at the rate applicable on the day the invoice is issued.
- The costs of shipping the goods are determined each time by the Seller, taking into account the type, weight, volume of the goods and their appropriate protection during transport, to which the Buyer agrees.
- After the payment has been recorded and the goods have been shipped, the Seller informs the buyer by email.
- The Seller sends the VAT invoice including the price of the goods and shipping costs to the Buyer by email or by post to the Buyer's address.
§5 - DELIVERY
- Goods ordered by the Buyer are delivered in one of the following ways:

- 6. Final provisions

- Any disputes regarding the promotion will be resolved by the organizer.
